What Does “Registered Marriage” Mean?
A registered marriage is one where the Nikah has been formally entered into the official record of the competent local civil-registration authority — the Union Council, Cantonment Board, TMA or (in Islamabad) the Arbitration Council. An unregistered Nikah may still be religiously valid, but it lacks the computerised Marriage Registration Certificate needed for most official purposes.
Why Registration Matters Legally
- Proof in court — registered marriages are far easier to establish in custody, maintenance or inheritance disputes.
- Visa and immigration — most spouse-visa processes require the computerised certificate, not just the Nikah Nama.
- Protecting the spouse’s rights — registration creates an official record that supports claims to maintenance, dower (haq mehr) and inheritance.
- Administrative matters — banks, employers and government departments generally ask for the registered certificate, not the Nikah Nama alone.
Registered Marriage vs an Unregistered Nikah
The Nikah itself — the religious contract — is what makes a marriage valid under Islamic law. Registration is the separate civil step that gets that marriage onto the government’s record. Couples sometimes delay registration for years; this is legally risky, since proving an unregistered marriage later (for a visa, a custody case, or an inheritance claim) can be far more difficult.
Frequently Asked Questions
Is an unregistered Nikah invalid?
Not necessarily under religious law — but without registration, the couple has no computerised Marriage Registration Certificate for official use, and proving the marriage later can be difficult.
How soon after Nikah should a marriage be registered?
As soon as practical. Delayed registration is usually still possible but may require additional evidence or steps depending on the local authority.
